Buildbox, an affiliate of AppOnboard, Inc., respects your privacy. This Privacy Policy describes how and why Buildbox collects, uses, discloses, stores and otherwise processes your personal data through our Buildbox software program, Website, and other related services (the “Buildbox Services”).

Buildbox provides the Buildbox Services, including the Buildbox software program that allows developers to create mobile applications (“Apps”) with little to no coding experience. The way we collect and use your personal data varies based on how you interact with our Buildbox Services. In order to help you find the information in this Policy that is most relevant to you, you should navigate to the sections that describe how you interact with Buildbox and the Buildbox Services.
When You create a User Account or accept one, download materials from the Company, or purchase the products or Services of the Company, You are agreeing to be subscribed to our e-mail newsletters, if any. You may also be asked for other information at the same or later time.
a. Buildbox Software Licenses and Payment
To download and use the Buildbox software, you will be required to provide your name, email address, date of birth and, if purchasing a paid version of Buildbox, your payment information. Buildbox processes this personal data to process payments for the software, ensure that licensees are of legal age, and to validate the authenticity of the installation and use of the Buildbox software. Buildbox may also use this information for analytics, marketing and customer support services as described in the corresponding sections below.
Buildbox’s payment processing portal is managed by Stripe Inc., 510 Townsend Street, San Francisco, CA 94103. Stripe will use the information you enter into the payment forms on our Website to process payments for Buildbox and may contact you regarding payment issues. The payment information you enter in the Stripe payment processing portal may also be used for analytics purposes through Baremetrics, as discussed below in the “Analytics” section.

Each Buildbox license is restricted to allow installations of the Buildbox software on a limited number of machines. To ensure that the number of installations has not exceeded the maximum allowed by the license terms, the Buildbox software collects your device’s Computer Name, IP Address, Account Name and MAC Address and compares it to your license permissions. Buildbox does this in accordance with the End User License Agreement and in its legitimate business interests to detect and prevent unlicensed distribution of the product.
Buildbox’s customer support system is Intercom, provided by Intercom, Inc., 55 2nd Street, 4th Floor, San Francisco, CA 94105. If you submit a customer support request or ticket, Buildbox will transmit the information you provide to Intercom for tracking and case monitoring as well as to follow up with you about your case. This means that Intercom may store your contact information, emails, support logs and any other information that you voluntarily transmit to Buildbox Support.

Buildbox uses analytics software provided by Mixpanel and Baremetrics to collect and summarize data regarding licenses and the performance of the software.
Mixpanel is an analytics service integrated into the Buildbox software program. Mixpanel is provided by Mixpanel, Inc., 405 Howard St., 2nd Floor, San Francisco, CA 94105. Mixpanel collects account, session, and usage data from the Buildbox software, including:

- Information about user events within the software, such as starts, loads, worlds, scenes, elements, gestures, previews, and publish actions;
- The license ID for the active Buildbox account, which cannot be re-identified by Mixpanel;
- Information about the Buildbox software, such as the version installed; and
- Device data such as the operating system, device ID and browser information.
Mixpanel collects this information from the Buildbox software and transmits it to Mixpanel for summary and analysis. Buildbox uses the information and analyses we receive from Mixpanel in order to achieve our legitimate business interests and to comply with our legal obligations. We process this information in order to:

- Provide, maintain, secure, and improve the Buildbox Services and to develop new services;
- Analyze account activity and provide service and support;
- Identify and prevent improper or fraudulent behavior; and
- Conduct personalized marketing as described below.
Baremetrics is an analytics service that provides insights based on the payment information made available to Buildbox by Stripe. Baremetrics is a service provided by Baremetrics, Inc., 3636 Cumberland Trace, Birmingham, AL 35242. Baremetrics collects payment and subscription data from Stripe, including:

- Information about the license and purchase, such as subscription type, discounts, time of purchase and method of payment; and
- Information about the purchaser of the license, such as billing address and contact details
Baremetrics collects this information from Stripe and transmits it to Baremetrics for summary and analysis. Buildbox does not allow Baremetrics to reuse any of this information for its own purposes. Buildbox uses the information we receive from Baremetrics in order to achieve our legitimate business interests and comply with our legal obligations. We process this information in order to:

- Provide, maintain, secure, and improve the Buildbox Services and to develop new services;
- Calculate appropriate charges for customers using Buildbox;
- Analyze account activity and provide service and support;
- Identify and prevent improper or fraudulent behavior; and
- Conduct personalized marketing as described below.
Buildbox offers personalized marketing for the Buildbox software and related products. Buildbox may combine your license information with the data received from Mixpanel and Baremetrics to learn how you as an individual use Buildbox’s services. Buildbox uses this information to identify products and services that may be of interest to you.
You may unsubscribe from such marketing emails or update your notification preferences at any time using the appropriate links at the bottom of the email you receive. Please note that Buildbox may still contact you for non-marketing purposes such as customer service responses, payments or transactions even if you unsubscribe from these marketing emails.
In some cases, Buildbox may offer special rates or promotions for its services. To take advantage of these offers, you may be required to provide personal data in order to complete the transaction and agree to Buildbox’s use of your personal data for marketing analytics purposes.
e. Visitors to the Buildbox Website
You may be asked to provide personal information on this Website, such as an email address to sign up for our marketing list. Providing this information is strictly voluntary.
Our Website also allows visitors to purchase a license for the Buildbox software. The “Buildbox Program Licenses and Payment” section above describes the information that Buildbox collects and uses from these signup forms in greater detail. Once you purchase a license, you may access your user account through the user portal where you can download the Buildbox software attached to your license, update your contact information and password, or request customer support as described in the “Customer Support” section above.
When you visit and use our Website, we also automatically collect and use certain data. We collect information in standard log files that may include your IP address, your Internet Service Provider (ISP), the Web browser you used to visit the Website, the time you visited the Website, which web pages you visited on the Website, and other anonymous usage data. Buildbox uses this information to secure our Services, to detect and prevent fraud, and to improve the quality and stability of our Website.
We use a technology called a “cookie” and similar identification technologies on our Websites. A cookie is a small file transferred to your computer or device that identifies you as a unique user. We use cookies to improve the quality of our Website and make it easier to use. We do this by storing information (for example, settings preferences) about a particular user session in cookies in order to provide you with a seamless experience during your visits. If you choose to do so, you can disable certain categories of cookies in the cookie preference banner on our Websites. Some cookies that are strictly necessary for the functioning of our Websites may not be disabled.
The Buildbox Website uses Google Analytics, a web analytics service of Google, Inc. (“Google”). Google Analytics uses cookie text files to analyze how our Website is used. Google uses the data stored on these cookies to compile reports on website activities and to provide further services related to the use of the Website. Google may also transfer this information to third parties if required to do so by law or if third parties process this data on behalf of Google.
You can object to browser data collection and storage by Google Analytics at any time by downloading and installing a browser deactivation add-on. The Buildbox Website includes social media features, such as social media plug-ins and links to our social media pages. These links may collect your IP address and which page you are visiting on our site. They may also set a cookie owned by the social media provider to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our site.
Your interactions with these features are governed by the privacy policies of the organizations providing them and may be determined by whether you are signed into your social media account when you access our Website. For example, if you create or log into your account through a third-party social networking site, we may have access to certain information from that site, such as your name, account information and friends, in accordance with the authorization procedures determined by the third-party social networking site. To prevent this, you can log off of your social media account before navigating to our Website.
The social media providers with features on the Buildbox Website have privacy policies that explain the information they obtain from these features and how you can limit this collection. The Website does not respond to web browser “Do Not Track” signals or other mechanisms that provide consumers the ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time. Buildbox has a Discord Server and a Xenforo forum to allow Buildbox software users to communicate and collaborate. Buildbox does not collect any analytics or personal data from these sites except what is made public by the users. Please review the privacy options available to you for your accounts on Discord and/or Xenforo to select the privacy protections that you prefer. Be aware that any information you choose to post on these forums may be visible to Buildbox and any other users as allowed by your privacy preferences.

g. Information Sharing and Disclosure
Buildbox may disclose information about our customers, business partners, and visitors to the Buildbox Website with certain third parties for lawful purposes. Buildbox does not share this information with unaffiliated third parties for their marketing purposes.
We may sometimes use other businesses (“Service Providers”) to perform certain services for us or on our behalf, such as analytics, messaging, payment processing, hosting and maintenance, and data storage and management services. We provide our Service Providers with the information reasonably necessary for them to perform these services on our behalf. Each Service Provider must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect your information from unauthorized access, destruction, use, modification or disclosure. Details about some of these Service Providers can be found in previous sections of this Privacy Policy.
The Buildbox Website may contain links to other sites. Buildbox is not responsible for the privacy practices or content of these other sites. When you leave our Website or view a portion of a third party’s site through our Website, you are responsible for reading the privacy policies of each such site. This Privacy Policy applies solely to information collected by Buildbox.
If you visit us on social media networks such as Facebook, Instagram, Twitter, LinkedIn, YouTube, Pinterest or Vimeo, then your personal data will be processed as described in both this Policy and in the privacy policy of the respective social media platform. Be sure to review the privacy policy for each social media network through which you interact with Buildbox to learn how and why each platform collects and processes your personal information.
Buildbox and others visiting our social media pages may view and interact with information you enter on our social media pages, such as comments, videos, images, likes, public messages, etc. Buildbox may delete content that you post to our pages should it be necessary, e.g., due to inappropriateness or regulatory guidelines. We may also use our social media accounts to communicate with you on these platforms.
Buildbox requires Business Partners to comply with all applicable laws and regulations regarding data privacy and security. Independently, our Business Partners are also required to comply with such laws and regulations. You are responsible for reviewing the privacy policies of sites you visit for information about those sites’ data collection and use practices.
Please be advised that we do not control and are not responsible for the privacy practices of any third party, including, but not limited to, Business Partners and any website or service that links to or from our Website or the Buildbox Services. We require Business Partners to maintain a privacy policy that fully and accurately discloses their data collection practices. Please be sure to review the privacy policies of any websites and applications that you may use.
h. Other Legal Purposes for Collection, Use or Disclosure
Buildbox and AppOnboard, Inc. may access, preserve, and disclose any information we have collected about you or that you have submitted to us as required for legal purposes, including:
- In response to subpoenas, court orders, or legal processes, or to establish, protect or exercise our legal rights or defend against legal claims;
- To protect the rights and property of AppOnboard, Inc., Buildbox, our business partners, our licensors, or the public;
- If we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or violations of the personal or intellectual property rights of others or situations involving potential threats to the safety of any person;
- To our corporate affiliates, joint ventures or other companies under common control with AppOnboard, Inc.; and,
- If Buildbox is acquired by or merged with another entity or in connection with a sale of our assets.
III. Other Important Information
a. Rights of European Union Residents
The European Union General Data Protection Regulation (“GDPR”) requires that Buildbox and AppOnboard, Inc. take particular measures to protect the personal data of European residents. If there is any conflict between this policy and the GDPR, the GDPR principles shall govern with respect to residents of the European Union.
Under the GDPR, you have the right to withdraw consent that you have given us to process your personal data (Article 7 GDPR); to request access to your personal data stored at Buildbox (Article 15 GDPR) and the right to data portability (Article 20 GDPR). You also have the right to request corrections (Article 16 GDPR), deletion (Article 17 GDPR) or restriction (Article 18 GDPR) of your personal data stored at Buildbox.
If you are not an end user, you may send your requests for access, correction, deletion or restriction to the privacy officer of AppOnboard, Inc. at privacy@apponboard.com.
If you are a European resident dissatisfied with the handling of your personal data by Buildbox or AppOnboard, Inc., you have the right to object to the processing of your personal data at any time (Article 21 GDPR). You also have the right to lodge a complaint with a supervisory authority. You may send your concerns or objections about the processing of your personal data to the privacy officer of AppOnboard, Inc. at privacy@apponboard.com.
We do not engage in activities that require parental notice or consent under the U.S. Children’s Online Privacy Protection Act (COPPA). Our Website and the Buildbox software are not intended to be used by children under the age of 13. If you believe that we have inadvertently collected information from a child under 13 that is subject to parental notice and consent under COPPA, please contact us at privacy@apponboard.com to request deletion of such information.
We use reasonable and appropriate security procedures and practices to protect information from unauthorized access, destruction, use, modification or disclosure. We also require our Service Providers to implement and maintain reasonable security procedures and practices appropriate to the nature of the information we share with them.
No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your information, we cannot and do not guarantee or warrant the security of any information transmitted to or from the Services.
d. Changes to This Privacy Policy
We may amend this privacy policy from time to time. If we make a material change to this policy, we will notify you by posting notice of these changes on our Website home page and in this Policy.
